Rights of way over private land should not generally be diverted without the consent of the local authority. However, landowners may temporarily offer a diversion, but only if it is safe to do so. It is the Inspectorate’s view that section 119(2)(b) does not restrict the point of connection of the diverted footpath, bridleway or restricted byway to a highway that is immediately connected to the highway to which the path formerly terminated. Just bringing these local issues to the surface without probing for the underlying causes does little to progress the case for access. This is because the duty to waymark is only where the council deems it necessary to help someone who isn’t familiar with the location. Councils reason that with walkers increasingly using GPS systems and maps on smartphones there is less need for waymarks.
